General terms and conditions of business
General terms and conditions, as of: February 2022
All deliveries and services are carried out exclusively in accordance with the following general terms and conditions in the currently valid version.
The customer's order represents an offer. A contract is only concluded after acceptance by us. The customer will be informed of acceptance by email. An order in advance is only possible if all mandatory fields marked * in the order form are filled out. If information is missing or we cannot fulfill the order for other reasons, the customer will receive an error message. Before the order is finally sent, the customer is given the opportunity to correct his order. The customer receives supporting detailed information directly during the ordering process. As soon as the ordering process is completed, the customer will be notified via an information window “Your order is completed and has been successfully shipped to us”. This does not constitute acceptance of the customer’s offer on our part.
Once we have received the order, the customer will be notified of receipt of his order via the email address he provided. This communication does not constitute acceptance of the customer’s offer on our part.
The customer is bound to his order for 2 days from receipt of this order. The statutory right of withdrawal (right of withdrawal) remains unaffected.
The purchase contract will be saved by us. If the customer wants to print out the contract text after placing his order, he can proceed as follows: Directly from the confirmation email. You can also log in to the system using the link " https://www.sticklett.at/account/ " on the website and the user data (email address, password) provided during the ordering process. The order data can be viewed and printed out in the customer account view.
The contract language is German.
6. Destination country
Our offer is aimed at customers with residence or habitual residence in Austria, Germany, Liechtenstein, Luxembourg and Switzerland. We also deliver throughout the EU and internationally.
All prices are total prices. They are inclusive of all taxes, including sales tax and information, and plus a flat rate for shipping costs for deliveries within and outside of Austria. According to the EU trade agreement, deliveries outside the EU may incur additional customs fees upon delivery.
We accept the following payment methods: Paypal, credit card, EPS transfer, Amazonpay, purchase on account with Klarna, Apple Pay, Google Pay;
If the payment method “purchase on account with Klarna” has not been agreed, the customer undertakes to pay the purchase price in full upon conclusion of the contract. The goods will be delivered after we have received confirmation of payment.
The term “right of withdrawal” commonly used in Austria corresponds to the term “right of withdrawal” commonly used in Germany and used in the Consumer Rights Directive. We therefore use the synonymous term “right of withdrawal (right of withdrawal)”. Only the term “right of withdrawal” is used in the cancellation policy. This is equivalent to the Austrian term “right of withdrawal”.

The right of withdrawal (right of withdrawal) does not apply to goods, especially clothing, if the goods have been washed by the customer after delivery. For hygiene reasons, the right of withdrawal for face masks no longer applies once the customer has taken possession of them.
In the case of rental (e.g. rental edition Mary by sticklett), the rental can be terminated by the customer at any time. The rental ends with the arrival of the goods after they have been checked and the clear written cancellation by email or in the Help Center. The return is also made to us. If you miss two months' rent without returning the device and terminating the rental agreement, a claim for damages in the amount of the device list price will be due and asserted. Rents that have already been paid cannot be refunded.
The provisions regarding the legal warranty apply. The warranty period for the delivery of movable items is 2 years from receipt of the goods. Wear and traces of use are not included in the warranty for clothing .
In addition to the statutory warranty, we grant a 2-year guarantee on labeled products.
Claims for damages in cases of slight negligence are excluded. This does not apply to personal injury or damage to items taken over for processing or product liability claims. In the event of negligent handling, for example disregarding the excellent application and care instructions and the associated consequences, sticklett.com's liability for damages is excluded.
Unless otherwise agreed, we will ship within 1-2 working days of our confirmation of the concluded contract.
The goods remain our property until full payment.
Rented products (e.g. rental edition Mary by sticklett) remain our property until the rent has been paid in full for one year. After 12 months have been paid, ownership passes to the tenant and there will be no further debits. In the event of loss/theft, either the rents will continue to be due until the 12 months have been paid or a remaining purchase price will be due immediately, deducting the previously paid rents from the valid list price.
The invention, which eliminates the changeable attachment and removal of appliqués on clothing items, is protected by a property right filed with the Austrian and German patent offices.
18. Severability clause
In the event that individual provisions of these General Terms and Conditions are and/or become ineffective, this will not affect the effectiveness of the remaining provisions and the contracts concluded on the basis of them. The ineffective provision must be replaced by an effective provision that comes closest to the meaning and economic purpose.
19. Contract Law
Substantive Austrian law applies to these General Terms and Conditions, excluding the reference norms of international private law and excluding the UN Convention on Contracts for the International Sale of Goods. For all disputes arising from or in connection with these General Terms and Conditions, the exclusive jurisdiction of the court with subject matter jurisdiction for 9020 Klagenfurt am Wörthersee (Austria) is agreed.
